APPROPRIATIONS

SENATE AMENDMENTS TO S.B. 1019

Strike everything after the enacting clause and insert:

"Section 1.  Joint legislative committee on evidence based practices in government programs; membership; duties; report; delayed repeal; definitions

A.  The joint legislative committee on evidence based practices in government programs is established consisting of the following members:

1.  One member of the house of representatives who is appointed by the speaker of the house of representatives and who serves as cochairperson of the committee.

2.  One member of the senate who is appointed by the president of the senate and who serves as cochairperson of the committee.

3.  Two persons who have experience in professional program evaluation, one of whom is appointed by the speaker of the house of representatives and one of whom is appointed by the president of the senate.

4.  Two persons from the administrative office of the courts who have expertise in developing evidence based programs in Arizona state government, who have previously or are currently participating in developing evidence based programs in Arizona state government and who are appointed by the chief justice of the supreme court.

5.  Three researchers, one from Arizona state university, one from the university of Arizona and one from northern Arizona university, who have expertise in the area of evidence based programs and program evaluation and who are appointed by the speaker of the house of representatives.

6.  One person from the private sector who has experience in business systems and procedures, who is not affiliated with any governmental entity and who is appointed by the president of the senate.

7.  The auditor general or the auditor general's designee.

B.  The committee shall:

1.  Develop procedures and methods to calculate the return on investment to taxpayers from evidence based programs.

2.  Establish procedures to evaluate all government programs to determine the extent to which each government program operates using evidence based practices, including specific criteria for the evaluation and guidelines on the use of professional evaluation staff.

3.  Provide a mechanism for reporting to the president of the senate, the speaker of the house of representatives and the governor on the extent to which each entity uses evidence based practices.

4.  Make recommendations on how to provide incentives to government entities to ensure that government programs operate using evidence based practices.

5.  Make recommendations for a time table to implement evidence based practices in government programs.

C.  The committee shall submit a written report of its findings and recommendations, including any proposed legislation.  The committee shall submit the report to the president of the senate, the speaker of the house of representatives and the governor on or before December 1, 2010 and shall provide a copy of the report to the secretary of state.

D.  This section is repealed from and after December 31, 2010.

E.  For the purposes of this section:

1.  "Best practices" means practices that on rigorous evaluation demonstrate success, have had an impact and can be replicated.

2.  "Evidence based practices" means the use of research and scientific studies as a basis for determining the best practices in a field.

3.  "Government programs" means any program that receives state or local funding."
