H2417: BANK CREATED MONIES; TRANSPORTATION INFRASTRUCTURE   The funding of all public transportation infrastructure must be achieved through the use of banks to create monies under the provisions of this legislation. Governmental agencies sponsoring a transportation project must submit documentation, including a bid value, to the State Treasurer. The Treasurer must notify all banks of the project and divide the bid value among all banks in proportion to their capital as of their most recent financial reports. Using the accepted ability of banks to create monies, each bank must create monies equal to its share of the bid value and electronically transfer the monies to the Treasurer. Session law requires the Treasurer and the Department of Transportation to complete a pilot project to test this procedure, and requires the first project after the pilot to be a light rail transit system. H2743: AIRPORT ASSESSMENT; LANDINGS & TAKEOFFS   Levies an assessment of $2 on each commercial airline passenger for each departure and arrival at an airline terminal in Arizona, to be collected from the operator of the airport terminal and due and payable at the same time as transaction privilege taxes. HCR2022: PHOTO RADAR; PROHIBITION ON HIGHWAYS   The 2010 general election ballot is to carry the question of whether to amend Title 28 (transportation) of Arizona Revised Statutes to repeal the statute that authorizes the state to install photo radar and to forbid the state and local jurisdictions from using photo enforcement to enforce any provision of the transportation code. First sponsor: Rep. Crump
S1018 (Chapter 266): PHOTO ENFORCEMENT PROCEDURES; JUSTICE COURTS   Photo enforcement systems must not be located within 600 feet of a speed change except in school zones. A sign clearly stating the speed limit must be posted between the two photo enforcement warning signs currently required. An action stemming from detection by a state photo enforcement system must commence within 120 days of the alleged violation. A county is authorized to add a processing fee to the $165 civil penalty for a photo enforcement citation. Retroactive from July 1, 2009, until the effective date of this bill, state photo enforcement citations can only be included in judicial productivity credit calculations if the citation resulted in a finding of responsibility or guilt. In FY2010-11, 40% of monies in the Photo Enforcement Fund after paying all expenses and court costs -- to a maximum of $7 million -- are transferred to the Public Safety Equipment Fund. Language requiring the Dept of Public Safety to contract with a vendor to establish a photo enforcement system on state highways is changed to permission ("shall" becomes "may"). S1387: PHOTO ENFORCEMENT; DPS; SIGNAGE   The state photo enforcement system is required to place an additional sign located 1,320 feet before the photo enforcement system, and a standard size speed limit sign must be placed within 6 feet of each photo enforcement sign. Photo enforcement citations cannot be issued using the state photo enforcement system unless these signs are in place and the violator is driving at least 11 miles per hour over the posted speed limit. S1388: SPEEDING CITATIONS; PHOTO ENFORCEMENT SYSTEMS   Photo enforcement systems cannot issue speeding citations unless the vehicle is traveling at least 11 miles per hour faster than 85% of the vehicles on the highway. The state or local authority with jurisdiction over photo enforcement systems must determine the minimum speed limit that will result in a speeding citation according to this guideline, based on vehicles traveling during nonpeak daylight hours under good weather conditions. S1443: PHOTO ENFORCEMENT PROCEDURES   Various changes related to photo enforcement. Photo enforcement systems cannot be placed within 600 feet of a posted speed limit change, except around a school crossing. A speed limit sign must be placed between the two photo enforcement notification signs. A citation may not be issued unless a vehicle is traveling at least 11 miles over the posted speed limit. An annual report on traffic statistics and amount of revenue produced from photo radar shall be submitted to the governor and Legislature by the Govenror's Office of Highway Safety by Aug. 1. Local jurisdictions that install photo radar must use a minimum of 35% of after-costs revenue for law enforcement purposes. A photo radar citation must be filed within 120 days (formerly 60 days) of the alleged violation. Off duty law enforcement officers are authorized to serve photo radar citations. The civil penalty for a violation detected by photo enforcement is $165 and is not subject to surcharges, except the clean elections surcharge. AS PASSED SENATE. First sponsor: Sen. L. Gray 4/28

A case must be filed within 120 of the alleged violation. If a person cited responds to the citation within 30 days of issuance, ADOT may not use the violation in a determination of whether to suspend or revoke the person's driver license.
