The Department of Economic Security is required to adopt rules requiring a parent or guardian of a participant in an early intervention program for infants and toddlers with developmental delays to pay at least 15 percent of the cost of the services if the participant's family income is at or above 150 percent of the federal poverty level.

Control of the "I Didn't Pay Enough Fund" is removed from the Department of Revenue and transferred to the Department of Health Services. DHS is required to use 50 percent of monies in the Fund to provide medicine to mentally ill persons and 50 percent of the monies to provide medicine to minors suffering from a chronic illness. Retroactive to January 1, 2012.

It is illegal to transport a minor in an open compartment of a motor vehicle (bed of a pickup) unless the minor is safely restrained. Includes exemptions for farm or ranch vehicles, emergency situations, vehicles on private property or Indian reservations, parades, and vehicles driven at or below a posted speed limit of 35 mph.

For the purposes of adult protective services, a written expression witnessed by at least two individuals who do not benefit from the withdrawal of services creates a rebuttable presumption that the person was competent to understand the expression. Transfers of assets for the primary purpose of obtaining eligibility for AHCCCS, supplemental security income, medicaid, medicare or veteran's administration programs and that are between a vulnerable adult and their spouse, disabled child or a trust for the spouse or disabled child cannot be construed as financial exploitation.

Beginning July 1, 2013, a person under 19 years of age whose gross household income is at or below 350 percent of the federal poverty guidelines and meets other specified requirements is eligible to purchase a benefits package through a newly established Children’s Health Share Program within KidsCare. The AHCCCS Administration is required to adopt rules to prescribe the application process, covered services and benefit limitations, and the collection of copayments and monthly premiums for program enrollees.

The Department of Economic Security is prohibited from implementing any change to administrative procedure, rulemaking or policy relating to procurement for services delivered to developmentally disabled children until Jun 30, 2013, retroactive to October 1, 2011. The Dept is required to ensure that each family with a child with developmental disabilities has a choice in service providers and has the ability to opt out of any particular program that is not meeting the child's needs.

It is a class 5 felony for any person who has care or custody of a minor or vulnerable adult and who knows of the existence of the minor's or vulnerable adult's body where death occurred in specified circumstances to knowingly fail to notify peace officers within two hours or as soon as reasonably possible. It is a class 6 felony for a person who has the care or custody of a minor or vulnerable adult to knowingly make a false statement to a law enforcement agency conducting a missing person investigation or felony criminal investigation involving the minor or vulnerable adult. It is a class 6 felony for a person who has the care or custody of a child under 13 years of age to intentionally or knowingly fail to report the child as missing to a law enforcement agency within 24 hours or as soon as reasonably possible after the person knew or should have known the child was missing. The classification is increased to class 4 felony if the child suffers death or serious physical injury while missing. AS PASSED SENATE.

Defines "bullying" as any written, verbal or physical act or any electronic communication that is intended to harm a student. Charter schools are required to prescribe and enforce policies and procedures to prohibit students from harassing, intimidating and bullyint other students. The policies and procedures must include specified elements. Also modifies the required elements of school district anti-bullying policies.

Declares that the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 are not authorized by the U.S. Constitution and are invalid and of no effect in Arizona. An official, agent or employee of the U.S. government or a corporation providing services to the U.S. government who enforces or attempts to enforce these laws is guilty of a class 4 felony. A public officer or employee of this state who enforces or attempts to enforce these laws is guilty of a class 1 misdemeanor. An aggrieved person has a private right of action against violators. SCR1030: APPROP OF STATE REVENUES; LIMITATION   

The 2012 general election ballot is to carry the question of whether to amend the state Constitution to prohibit the Legislature, beginning with FY2014-15, from appropriating state revenues in excess of appropriations for the preceding FY, adjusted by the percentage changes in state population and cost of living. This limitation may be suspended for one FY on approval by the voters or in case of a declared emergency and by a vote of at least 3/4 of each house of the Legislature. The limitation does not apply to deposits in a budget stabilization fund, tax refund programs, or repayment of debt obligations. Any resident taxpayer of the state has standing to enforce the limitation in court.
