Provisions

  • Removes the words "in a position ordinarily filled by the employee of the employer" from A.R.S. 38-766.02 as it relates to charging an employer an alternate contribution rate when hiring an ASRS retiree

Summary

The ASRS believes that by removing this language a loophole will bill closed whereby employers were attempting to circumvent the payment of an ACR through minor changes to a position's title or scope. 

 

This bill has passed both chambers of the legislature and been signed by the Governor.

2017 ASRS LEGISLATIVE INITIATIVE

Provisions

  • Clarifies A.R.S. § 38-738 to ensure compliance with Internal Revenue Code (IRC)
  • Under § 38-738(A) modifications are being made to clarify the method in which the ASRS can return monies to employers who have overpaid contributions, in compliance with IRC
  • Provisions to § 38-738(B) clarify that a correction of prior credited service must be repaid in compliance with the IRC and that members who are retired, inactive, or on long-term disability can only purchase this service using after tax monies
  • Ensures that individuals who forfeit their retirement account pursuant to § 38-742 can only request an adjustment in service [§ 38-738(B)] from their most recent membership date forward.

Summary

The ASRS proposed changes conform to Internal Revenue Code restrictions as it relates to employer overpayments of contributions as well as employee underpayment of contributions.

2017 ASRS LEGISLATIVE INITIATIVE

Provisions

  • Modified language in A.R.S. § 38-742 to indicate a member reinstating their service must repay the amount the "ASRS paid" rather than the amount the "member received".

Summary

When A.R.S. § 38-742 is read without context provided by A.R.S. § 38-773, regarding Domestic Relations Orders, one might assume that amounts paid to an ex-spouse at the time of a forfeiture are not included in repayment requirements in the event the forfeiting member becomes re-employed with an ASRS employer and would like to reinstate their service credits.

A member with previously forfeited service credit must repay the amount the ASRS paid upon withdrawal, plus interest, to receive all credits previously forfeited. 

The proposed language conforms with the previous analysis that § 38-742 requires the amount the member received and § 38-773 articulates that a member's monies are assigned to an alternate payee. Thus, in a forfeiture, the member is technically receiving the full amount of the forfeiture but pursuant to a court order (DRO) the monies are assigned to the ex-spouse.

2017 ASRS LEGISLATIVE INITIATIVE

Provisions

  • For the purposes of retirement, allows the ASRS to collect an overpayment from a member's Partial Lump Sum distribution before rolling the remaining monies into a qualified plan.
  • For the purposes of refunds, allows the ASRS to collect an overpayment from a member's refund distribution before rolling the remaining monies into a qualified plan.

Summary

Individuals who are awarded Long Term Disability (LTD) benefits through the ASRS are required to apply for Social Security Disability (SSD) through an administrative hearing and the ASRS is required to offset the member's LTD benefit by 85% oe amount they are receiving through SSD. In the event a member is awarded SSD benefits, they must repay the ASRS the amount overpaid retroactive to the date of disability. 

Nearly 95% ol members awarded SSD repay the ASRS their overpayment amounts prior to retirement. However, for those who have failed to repay the ASRS, the agency is asking for permission in statute to collect those funds from a lump sum distribution to the member.

2017 ASRS LEGISLATIVE INITIATIVE

Provisions

  • Permits the ASRS Board to establish a Committee of the Board for the purposes of determinations following an administrative hearing for Articles 2.1 and 7 of Title 38, Chapter 5

Summary

In the 2016 Legislative Session the ASRS pursued SB1037 which permitted the ASRS Board to establish a Committee of the Board for agency determination following administrative hearings. However, the ASRS only included Article 2. Thus, the Board was not permitted to establish a Committee of the Board for any appeals covered under Article 2.1 or Article 7. The passage of this bill would permit the Appeals Committee to hear all appeals under ASRS articles. 

 

This bill has passed both chambers of the legislature and been signed by the Governor.

2017 ASRS LEGISLATIVE INITIATIVE

Provisions

  • Makes changes to and broadens the definition of a nonparticipating employer, to include scenarios not previously contemplated, for the purposes of charging a liability. 
  • Provides clear changes to how the ASRS actuary would calculate a nonparticipating employer's liability.
  • Indicates the employer and employee contribution rate would remain the same as the plan contribution rate. However, the nonparticipating employer would be invoiced an additional amount annually to account for their share of the liability.

Summary

In the 2010 Legislative Session SB1045 passed, privatizing the State Compensation Fund (SCF). SCF Arizona was a participant of the ASRS under the "state" participation requirement in A.R.S. 38-711. After identifying that the removal of an employer from the retirement system would result in that employer no longer paying their portion of the unfunded liability the ASRS came back to the legislature in the 2012 Legislative Session to pass A.R.S. 38-751 thereby allowing us to charge a liability to an employer no longer participating in ASRS.

However, in recent years the ASRS has reviewed the statute and identified additional scenarios where an employer could be no longer participating in the ASRS but as a result of language in current statute a liability could not be charged to the employer. 

Consequently, the ASRS is pursuing modifications to A.R.S. 38-751 that would include employers who:

  • Through legislative action have current and/or prospective employees no longer participating in the ASRS. 
  • Have a reduction in participation to the ASRS of 30% o a period of 3 years of 50% o any period of time.

Additionally, the current version of A.R.S. 38-751 indicates the ASRS would charge employers a lump sum liability to be paid at the determination of the ASRS. Large liabilities could not likely be paid in a short period of time and as a result, the following changes have been made:

  • Set a separate fund for the employer allocating the employer their share of assets and liabilities in the plan.
  • ASRS Actuary is the sole party responsible for calculating the unfunded liability. 
  • Through payroll deductions, employers and employees of nonparticipating employers will have the same contribution rates as all other participants in the ASRS.
  • Any share of the annual liability amount not received through payroll will be billed to the employer and must be paid within the same fiscal year as when it was billed.
  • Each additional year after that the nonparticipating employer will have a separate actuarial valuation from the plan and will be invoiced for their annual share of the unfunded liability.
  • All costs associated with an employer becoming nonparticipating will be charged to the employer.

Each of the above modifications exists to ensure that the liabilities incurred by a nonparticipating employer are not transferred onto all other employers and employees remaining in the ASRS.

  • Employees who are currently members of ASRS and becomes employed with a political subdivision entity or those currently employed with a political subdivision entity will maintain their membership in ASRS.

The ASRS has identified 15 employers that would be impacted by this bill:

Fiscal Impact

The ASRS actuary predicts contributions attributed to paying down the UAAL will decrease by approximately $32.1M in present value (over 30 years), which would be paid by the remaining employees and employers of ASRS. This equates to a contribution rate increase of about 0.03 percent in most years. There is a ramping up of the contribution effect from 0.0 percent in FY2017 to the 0.03 percent in FY2025.

Summary

In the 2011 Legislative Session, and effective 07/20/2011, a 6-month waiting period for participation in ASRS was passed for state employees. HB2169 repeals that waiting period going forward. Thus, if passed, on the effective date any state employee who is within their first 6-months of employment will be immediately required to participate in ASRS.

  • Removes minimum age requirements for achieving Normal Retirement for members of PSPRS

Summary

For PSPRS members appointed on or after July 1, 2012, but before July 1, 2017, participants must have completed 25 years of credited service to qualify for normal retirement. Currently, a participant needed 25 years of service and must have attained age 52-1/2.

For PSPRS members appointed after July 1, 2017, must have completed 15 years of credited service to qualify for normal retirement. Currently, a participant needs 15 years of service and must have attained age 55.
